§ 1 Scope of Application
These GTCs apply to all orders placed with "PRINTED BY 4FINGERSUP". We offer individually printed textiles. Inquiries are made via the contact form on our website, by email, Instagram, or other direct means. All products, prints, quantities, prices, and other details are agreed upon individually in advance.
§ 2 Formation of Contract, Approval, and Changes
A contract is concluded as soon as all important order details have been agreed upon between the customer and 4FINGERSUP. The customer will then receive all relevant documents digitally, in particular the invoice and the print approval with the agreed details.
The order is only considered binding once the customer confirms the invoice or approval digitally or returns it signed. By this confirmation, the customer also accepts these GTCs.
With the approval, the customer confirms that all order details are correct. This includes, in particular, the design, text, colors, sizes, positions, quantity, and selected products.
After final approval, changes are generally no longer possible. If subsequent changes can still be implemented, this is only possible by arrangement and against reimbursement of the additional costs incurred.
§ 3 Prices and Payment
All prices are agreed upon individually. As 4FINGERSUP operates as a small business, no sales tax is shown. Payment is made by bank transfer unless otherwise agreed. We only begin production or ordering of textiles after full payment has been received.
§ 4 Delivery
Production and delivery take place by arrangement, usually within 14 working days after receipt of payment and final approval.
The stated delivery date may be postponed if ordered textiles, blanks, materials, or other necessary products are unavailable and this delay is beyond the control of 4FINGERSUP. In this case, we will inform the customer as early as possible.
The goods can be picked up by arrangement or shipped within Germany. Shipping costs are borne by the customer, unless otherwise agreed.
§ 5 Defects, Print Data, and Customer-Supplied Textiles
If the textiles are procured by 4FINGERSUP, we are liable for ensuring that the delivered product corresponds to the agreed order. This includes the selected textile and the print applied to it.
If the customer supplies their own textiles or sends them to us, we are not liable for problems arising from the textile itself. This includes, in particular, pre-existing damage, material defects, unsuitable fabrics, coatings, pre-treatments, or other properties of the textile that affect, impair, or make printing impossible. In this case, we are only liable for errors that occurred directly due to our printing process.
If the customer provides their own print data, designs, or files, we generally check them before printing and correct them if possible or point out recognizable problems. Nevertheless, we are not liable for errors that are inherent in the template itself or that cannot be avoided despite our inspection. This includes, for example, poor image quality, insufficient resolution, transparency errors, incorrectly created colors, spelling errors, imprecise positioning, or other errors in the file supplied or approved by the customer.
With the final approval, the customer confirms that all order and print details are correct. This includes, in particular, the design, text, colors, sizes, positions, and quantity.
Slight deviations in color, print position, or size may occur due to technical or material reasons and do not constitute a defect, as long as the product remains normally usable.
We are not liable for damage caused by incorrect care, incorrect washing, tumble drying, ironing, natural wear and tear, or subsequent further processing by the customer or third parties. The care instructions must be observed.
§ 6 Right of Withdrawal
There is no right of withdrawal for individually manufactured or printed products created according to customer specifications.
§ 7 Rights to Designs and Print Data
The customer is responsible for ensuring that they possess the rights to all designs, logos, texts, images, or other templates that they provide to us. The customer indemnifies 4FINGERSUP against third-party claims if rights are infringed by a template supplied by the customer.
§ 8 Liability
We are liable without limitation for intent, gross negligence, and for damage to life, body, or health. In cases of slight negligence, we are only liable if an essential contractual obligation has been violated and only for the typical, foreseeable damage. Otherwise, the statutory provisions remain unaffected.
§ 9 Retention of Title
The goods remain the property of 4FINGERSUP until full payment has been received.
§ 10 Final Provisions
German law applies. Should individual provisions of these GTCs be or become invalid, the remaining provisions shall remain unaffected.
